Unpaid zakat when someone dies

People find this in a week when the fridge still has their milk. The household wants a clean number. There may not be one.

Order of operations

  1. Funeral costs, in the usual way.
  2. Debts, including zakat they owed if that is how your advisors treat it.
  3. The wasiyyah, up to a third, if they left one.
  4. The faraid shares.

How to estimate without lying

Bank and metal statements for the last hawl you can see. A note of gold in the house. If they used our calculator, a screenshot in their files is a gift. If they did not, do not invent a live silver price for a year you cannot document — use the records you have and name the uncertainty to whoever is advising the estate.

Does it come before the will's one-third?
Debts are generally settled before bequests. Unpaid zakat is often treated as a debt. Confirm with someone who can see the estate.
What if they never kept records?
You cannot invent a perfect number. Use statements you have. Do not perform precision you do not own.
Can heirs refuse?
Heirs do not get to erase a debt because it is religious. How a court treats it is a different system.
